INTRODUCTION AND ACCEPTANCE 

These Terms of Service ("Terms") constitute a legally binding agreement between you and Pawshare Club Pty Ltd (ABN: 84685619443) ("we", "us", "our", "Pawshare Club") governing your use of our mobile application, website, and related services ("Services"). 

By accessing or using our Services, you agree to be bound by these Terms, our Privacy Policy, andCode ofConduct. If you do not agree, immediately cease using our Services.

1. DEFINITIONS 

"User" means any person who accesses or uses our Services "Content" means all materials, information, text, graphics, photos, videos, or other content 

"Personal Information" has the meaning given under the Privacy Act

1988 (Cth) 

"Pet Care Services" means pet sitting, walking, boarding, and related services facilitated through our platform
"Australian Consumer Law" or "ACL" means Schedule 2 of the Competition and Consumer Act 2010 (Cth) 

2. ELIGIBILITY AND ACCOUNT REQUIREMENTS 

Age Restriction: Our Services are exclusively available to individuals aged 18 years or older. By creating an account, you warrant that you meet this requirement. 

Account Responsibilities: 

Provide accurate, complete, and current information during registration Maintain the confidentiality and security of your account credentials Immediately notify us of any unauthorized use or security breach Comply with identity verification requirements when requested Ensure all account information remains up-to-date 

Account Termination: We may suspend or terminate accounts that violate these Terms, engage in fraudulent activities, or pose safety risks to our community. 

3. PERMITTED AND PROHIBITED USES 

PermittedUses: 

Access pet care services as advertised 

Create user profiles and post appropriate content

Communicate with other users through our platform 

Provide feedback and reviews in good faith 

Report inappropriate behavior or content 

ProhibitedUses: You must not: 

Engage in fraudulent, abusive, illegal, or harmful activities Harass, threaten, or discriminate against other users 

Post false, misleading, defamatory, or inappropriate content Violate intellectual property or privacy rights of others 

Attempt to circumvent security measures or gain unauthorized access Use our Services for commercial purposes without written consent
Share account credentials or create multiple accounts without permission
Post content that violates animal welfare laws or promotes animal cruelty 

Community Safety: We maintain a zero-tolerance policy for behavior that compromises user safety, pet welfare, or platform integrity. 

4. PETCARE SERVICES AND RESPONSIBILITIES 

Service Facilitation: Pawshare Club provides a platform to connect pet owners with service providers. We do not directly provide pet care services and are not responsible for the quality, safety, or legality of services arranged through our platform. 

User Responsibilities: 

Pet Owners: Provide accurate pet information, including medical conditions, behavioral traits, and emergency contacts when applicable

Service Providers: Maintain appropriate insurance, licenses, and qualifications as required by local law
All Users:
Exercise reasonable care and judgment in all interactions and service arrangements 

Safety and Insurance: We strongly recommend all users maintain appropriate insurance coverage. Pet care services involve inherent risks, and users assume responsibility for their participation. 

Background Checks: We may conduct background checks on service providers, but do not guarantee their completeness or accuracy. Users should exercise independent judgment when selecting services. 

5.USERCONTENTAND INTELLECTUAL PROPERTY 

Content License: By submitting Content to our platform, you grant Pawshare Club a non-exclusive, worldwide, royalty-free, revocable license to use, modify, display, and distribute your Content solely in connection with providing our Services. This license terminates when you delete Content or close your account, except for Content that has been shared with other users. 

Content Ownership: You retain ownership of your Content and represent that you have all necessary rights to grant the above license. 

Content Standards: All Content must: 

Be accurate, lawful, and not misleading 

Respect privacy and intellectual property rights 

Comply with our Community Guidelines 

Not contain harmful, offensive, or inappropriate material

Content Moderation: We reserve the right to review, remove, or modify Content that violates these Terms or is otherwise inappropriate, but are not obligated to monitor all user submissions. 

Intellectual Property Protection: Our Services, trademarks, logos, and proprietary technology are protected by intellectual property laws. Unauthorized use is strictly prohibited. 

6. PAYMENT TERMS AND CONSUMER GUARANTEES 

Payment Processing: All payments are processed securely through third-party providers. We do not store complete payment information on our systems. 

Subscription Services: Premium features may be available through paid subscriptions with the following terms: 

Subscriptions renew automatically at the end of each billing period (e.g., monthly or annually), unless cancelled

We may change plan prices or features; we’ll notify active subscribers in advance.

You can cancel any time via subscription page. Cancellation takes effect at the end of the current billing period (you retain access until then).

Assisted cancellation. If you can’t access your account or subscription page, email info@pawshareclub.com from your registered email address; we’ll process it and confirm by email.

All payments made through Pawshare Club are non-refundable unless otherwise required by law


When requesting a refund, email info@pawshareclub.com with: account email, invoice number, date, amount, and reason. We aim to respond within a few business days

We will refund or credit where:

Duplicate billing or our billing error occurs (refund of incorrect charges).

No refunds are available for change of mind or for any unused portion of a billing period once it has commenced, except as required by law (including the Australian Consumer Law) or under our 30-day Money-Back Guarantee for eligible campaign sign-ups.

We don’t control bank/issuer fees, currency conversion, or taxes applied by others. Those charges are your responsibility unless caused by our error.

Refund Policy: In accordance with Australian Consumer Law: Services must be fit for purpose and match descriptions 

You may be entitled to refunds for services not delivered as promised

Refunds for digital content may be available if content is defective Processing fees may be non-refundable where permitted by law

When requesting a refund, email info@pawshareclub.com with: account email, invoice number, date, amount, and reason. We aim to respond within a few business days

Assisted cancellation. If you can’t access your account or subscription page, email info@pawshareclub.com from your registered email address

Consumer Guarantees: Nothing in these Terms excludes, restricts, or modifies consumer rights under the Australian Consumer Law, including consumer guarantees regarding acceptable quality, fitness for purpose, and compliance with description. 

7. PRIVACY AND DATAPROTECTION 

Data Collection: Our collection and use of personal information is governed by our Privacy Policy, which forms part of these Terms. 

Location Services: We may collect location data with your consent to facilitate service matching and safety features. Location tracking can be disabled through device settings, though this may limit functionality. 

Third-Party Analytics: We may use analytics services including Meta Pixel to improve our Services. You can opt out through your privacy settings or browser controls. 

Data Security: We implement appropriate technical and organizational measures to protect your information, but cannot guarantee absolute security. 

8. LIABILITY AND RISK ALLOCATION 

Service Disclaimer: Our Services are provided "as is" and "as available." While we strive for reliability, we do not guarantee uninterrupted, error-free, or secure access to our platform. 

Limitation of Liability: To the extent permitted by law, our liability for any claims arising from or relating to these Terms or our Services is limited to: 

The amount you paid for Services in the 12 months preceding the claim, or 

$100, whichever is greater 

Excluded Liability: We are not liable for:

Acts or omissions of other users or third-party service providers 

Loss of data, profits, or business opportunities 

Indirect, consequential, or punitive damages 

Claims arising from your breach of these Terms 

Consumer Law Protection: Nothing in this section excludes liability that cannot be excluded under the Australian Consumer Law, including liability for death, personal injury, or misleading conduct. 

Indemnification: You agree to indemnify and hold us harmless from claims, damages, and expenses arising from your use of our Services, violation of these Terms, or infringement of third-party rights. 

9. DISPUTE RESOLUTION AND GOVERNING LAW 

Governing Law: These Terms are governed by the laws of Victoria, Australia, and any disputes will be subject to the exclusive jurisdiction of the Victorian courts. 

Dispute Resolution Process: 

Direct Resolution: Contact info@pawshareclub.com to resolve disputes informally 

Mediation: If direct resolution fails, disputes may be referred to mediation through appropriate official channels such as the Resolution Institute 

Court Proceedings: Unresolved disputes will be determined by Victorian courts 

Consumer Dispute Rights: Nothing in this section affects your rights to pursue remedies through Victorian Consumer Affairs, the Australian

Competition and Consumer Commission, or relevant ombudsman services. 

Class Action Waiver: You agree that disputes will be resolved individually, not through class action proceedings, except where such waivers are prohibited by law. 

10. TERMINATION AND ACCOUNTCLOSURE 

Termination Rights: Either party may terminate this agreement at any time: 

By You: Through account settings or by contacting customer support
By Us: With or without cause, with reasonable notice except in cases of serious breach 

Effect of Termination: 

Your right to use our Services ceases immediately 

We may delete your account and associated data in accordance with our Privacy Policy 

Outstanding payment obligations survive termination 

These Terms remain binding for matters occurring before termination 

Data Retention: Following termination, we will handle your personal information in accordance with our Privacy Policy and applicable data retention requirements. 

11. MODIFICATIONS AND UPDATES 

Term Changes: We may modify these Terms at any time to reflect: 

Changes in applicable law or regulation 

New features or service offerings 

Enhanced security or safety measures 

Clarifications or corrections

Notification Process: 

Where possible, Material changes will be announced with 14 days' advance notice 

Notice will be provided through our platform, email, or other reasonable means

However, in certain circumstances — such as legal, regulatory, or security-related updates that require immediate implementation — we may make changes effective immediately. In such cases, we will notify users as soon as reasonably practicable after the change.


Continued use after the effective date constitutes acceptance of modified Terms 

Rejection of Changes: If you do not agree to modified Terms, you may terminate your account before the effective date. 

12. GENERAL PROVISIONS 

Entire Agreement: These Terms, together with our Privacy Policy and Code of Conduct, constitute the complete agreement between you and Pawshare Club regarding our Services. 

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. 

Waiver: Our failure to enforce any provision does not constitute a waiver of that provision or any other rights. 

Assignment: We may assign our rights and obligations under these Terms. You may not assign your rights without our written consent. 

Force Majeure: We are not liable for delays or failures due to circumstances beyond our reasonable control, including natural disasters, government actions, or technical failures. 

Survival: Provisions relating to intellectual property, liability, indemnification, and dispute resolution survive termination of these Terms.
